Litigation Services

From the commencement of time persons have disagreed with each other. The disagreement may have been resolved with words or a hand shake or in other cases where the parties were not able to resolve their differences, a court or tribunal made a determination based on the facts as to who was right and who was wrong.

The ideal question is whether a party namely, companies, employers, employees, spouses, insurance companies, persons who have suffered personal injuries, partners, banks, ship owners, construction contractors, consumers, all who may have suffered a loss, injury or contract or whose services were terminated can obtain excellent and effective service  in resolving their disputes?

Disputes can be resolved in many ways; litigation is only one of them and should be used as a last resort. Our position is to promote and negotiate settlement of our Clients’ disputes in a timely and most cost-effective manner. However, we are also aware and appreciate that some matters will not be settled amicably between the parties and therefore we ensure that matters which are litigated are done so expeditiously.

The Supreme Court of the Commonwealth of The Bahamas recognizes that we have both local and foreign litigants and therefore the Supreme Court “will deal with the cases expeditiously and fairly”. Further it recognizes and facilitates other forms of alternative dispute resolution, such as mediation.  Accordingly Order 31A of the Rules of the Supreme Court was introduced on the 1st July, 2004 to “achieve the fair and expeditious disposal of proceedings; the saving of costs, the elimination of any element of surprise; the promotion of a fair settlement between the parties; the avoidance of a trial, if possible; the identification of the real issues and elimination of unnecessary issues and the encouragement of the parties to make admissions of fact.”

Our firm is also involved in defending ship owners in the release of arrested vessels, and the entering of caveats for persons who have provided goods and services to ship owners.  We are also agents for insurers.
